There is no EU harmonised approach regarding compliance controls on REACH obligations. The enforcement is the responsibility of national authorities in the 27 EU Member States. National authorities have different approaches to checking whether products are REACH compliant or not, and they also take different stands towards self-certification and information requirements. Moreover sanctions for non compliance differ greatly between the Member States, as each state has its own judicial system. Member States have already adopted sanctions for non-compliance with REACH, which range between a simple fine and years in prison for the responsible senior management.
